Relief for MCA’s as Degree rule abandoned by the IEBC

Independent Electoral and Boundaries commission Chairman Wafula chebukati. the chairman has indicated that the Commission will not require the MCA'S to have degree requirements in line with a recent high court ruling.

The members of county assemblies (MCA’s) can now smile all the way to the ballot. This is after the IEBC decided to abandon a previous policy that indicated that all aspirants seeking the MCA seat must have degrees. A petition had been filed by a Kenyan in the high court seeking clarification on the same.

The high court ruled in favour of the petitioner finding that the degree rule was unfair and unconstitutional. There has been calls in the past to have MCA’s who have degrees. This would unable the county assemblies to have learned leaders who could be able to make clear and effective laws at the county level.

The ruling made it clear that members of county assemblies don’t need to have any educational qualifications to vie for the position.

Currently  the County assemblies are grappling with ineffective leadership and badly written laws that have been challenged court. It was clear for the IEBC to assume that a higher education requirement would bring sanity to the county governments.

Puppets

In most counties the MCA’s have been turned in puppets by their governors.Some Governor’s use this legislators mainly to pass bills and budgets that favour the executive at the county level. This bills and budget don’t even get any Opposition. This signify’s that the legislators at times don’t understand their basic rights and privileges.

The electoral commission has however indicated that all aspirants seeking the position of MP should have their Degrees. According to Wafula Chebukati the high court hasn’t ruled on the requirement by the time of this publication.
