Political witch hunt? As Amos Kimunya verdict overturned by High Court

Former Kipipiri Member of parliament is facing an imminent Jail term if he losses his defence. Amos Kimunya was charged with land Fraud and Abuse of office. This charges were brought against the Ex-Majority leader were from his stint as a cabinet minister. Kimunya served at the lands and housing ministry where the criminal activities took place.

Kimunya and his co-accused Lillian Njenga had been acquitted by the anti-corruption magistrate court in 2021. The DPP had filed an appeal with the high court division of the Anti-corruption court. Both Kimunya and Njenga had been accused of transferring land illegally to Midlands Company limited in 2005.

The case against the two started in 2014. According to the chief magistrate who acquitted the Two, the case lacked enough evidence to jail the accused persons. At the time of the ruling , Kimunya was a powerful politician in the Uhuru government. He was serving as the majority leader for the ruling party jubilee. Politicians and other analysts opposing the government at the time indicated that the acquittal was sponsored by the party.

Evidence

Justice Esther Maina indicated that the accused should present themselves to the chief magistrate court on 11th October 2022 to defend themselves. Failure to attend the court hearing will lead to an arrest warrant being issued. While ruling in favour of the prosecution.The judge indicated that the prosecution had provided enough evidence to prove that the accused were involved in the crime.

Amos Kimunya will become the first powerful politician in the Uhuru government to appear in court on corruption charges. This decision comes at a time that the Kenya Kwanza government has stepped up efforts to ensure the independence of Government institutions. To this effect the president has designated the inspector general of police as the Accounting officer. This gesture means that the inspector general will now be responsible for all the funds in the police service.
