The Kibera High Court has ordered the country’s prison authorities to present Rose Mbithe Mulwa and her two children, Chris Mulwa and Angela Mulwa, in court to appear before the court on murder charges related to the killing of lawyer Mathew Kyalo Mbobu.

Justice Diana Kavedza ordered Industrial Area Prison and Lang’ata Women’s Prison, on Thursday, October 8, 2026, to produce the three accused persons for plea-taking on October 27, 2026.

The three people named above are among five persons mentioned in the charge sheet in respect of the murder of Mbobu, who was shot dead on September 9, 2025. The other two accused persons are police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemboi Borboroi as mentioned in the charge sheet.

This development comes after the Directorate of Criminal Investigations (DCI) concluded its investigations related to the murder of Mbobu. Mohamed Amin, the DCI Director announced in September 2026 that detectives had arrested a police officer suspected of pulling the trigger in the shooting and recovered a Ceska pistol that had been issued to the accused police officer.

Amin stated that ballistic tests had established that the firearm mentioned above had been used in the shooting that claimed Mbobu’s life.

“Ballistic examination has since confirmed that the firearm was indeed used in the shooting that claimed the life of Lawyer Mbobu,” Amin stated.

The DCI further alleges that another police officer, Inspector Kenneth Sang, who is yet to be arrested, had been in charge of the operation and had been in constant communication with Mbithe. These allegations are yet to be tested in court.

Mbobu, a former chairman of Political Parties Disputes Tribunal and a leading lawyer, was shot on Magadi Road in Nairobi on September 9, 2025. According to reports, Mbobu’s vehicle was blocked by unknown suspects on a motorcycle, from which the murder was fired.

Rose Mbithe Mulwa and her two children are also charged with the murder of Dr Victoria Nthunya Mutiso, who was shot dead in Nairobi in July 2026. The two murder cases have gained public interest following the allegations of conspiracy between the suspects mentioned in the two cases. However, the cases are yet to be determined in court.

According to the latest developments, Mbithe, Chris and Angela will be back in court on October 27 to plead guilty or not guilty to the charges leveled against them in respect of the alleged murder of Mbobu. The court proceedings will take place, and the accused persons will enter their pleas in response to the charges levied against them. The three suspects are innocent until proven guilty in a court of law.
