Foreigners Charged for Duping businessman 215 million in a fake gold scam

On Tuesday, January 24,2023 two foreigners were charged before a Nairobi court with duping a businessman of Ksh.215 million in a fake gold scam deal

The foreigner from Gabon, Ted Malik and Cameroonian ,Abdallah Mckenzy appeared before Milimani Chief Magistrate Lucas Oyina where they denied the charges of obtaining money by false pretences.

The prosecution alleges that , the two foreigners obtained Ksh.215,176.500 from businessman Celik Mesut by falsely pretending they were to sell 33kilograms of Gold.

“On diverse dates between the month of October and December 10, 2022 at Kilimani within Nairobi county, the accused persons Abdallah Mckeny Mckenzy and Malik with the intend of defraud, jointly with others before the court, obtained from Mesut the sum USD30.451 pretending you were in a position to sell 33 kilograms of gold value at USD 1.732.500 a fact you knew was false.” the charge sheet read.

The two accused persons denied the charges and sought to be released on reasonable bail terms claiming they will abide all conditions the court set.

Court’s order

However, the prosecutor Anderson Gikunda strongly opposed their release on bail terms , pending the hearing of the case, on grounds that they are a flight risk being foreigners.

In addition to that, the prosecutor informed the court that the accused Ted Malik has no known place of abode and that on December 23,  2023 he was charged and fined Ksh. 136,000 before Kahawa law courts for being unlawfully present in Kenya.

“Your honor the accused persons are a flight risk , we will be urging his honorable court to deny the accused persons bond , ad the matter be heard on a priority basis, the prosecutor submitted.

However, the defense objected to the application by the DPP to deny the accused persons bond, stating that the application violates human rights.

The magistrate ordered the accused person to be detained at Industrial Area remand prison until January 26,2023 , when he will deliver a ruling on whether the accused to be granted bail or be detained pending the hearing of the case.
