Court Puts Hold On Shakahola Inquiry

Post by : Hillary Musyoki

Kenya’s High court has temporarily issued an hold on the commission of inquiry into the ‘Shakahola Massacre’ from starting its sitting until a case filed by Azimio leader Raila Odinga is resolved.

The order was issued by Justice Lawrence Mugambi who told the commission not to commence their sittings until he gives new orders on Monday.

Azimio through their lawyer Paul Mwangi objected the formation of the commission saying President Ruto went against the constitution and usurped powers of other state organs.

Azimio also found issues with the appointment of lady justice Jessie Lessit to head the commission saying the action will compromise the independence of the judge and if cases concerning the Executive came before her , she was likely to favor her appointing authority.

Raila Odinga is seeking orders from the court for the commission of inquiry to be declared unconstitutional for infringing on the mandate of the Director of Public Prosecution, Independent Policing Oversight Authority, Inspector General and Kenya National Human Rights Commission(KNHRC).
