Post by : Hillary Musyoki

In Kenya, a number of couples are struggling to get children of their own due to various reasons ,including medical complications.

Kenyas fertility rate has dropped in a high note . With  3.9 births per rate down from 7.9 in the 1960’s.

Though many of the ‘fertile’  millenials opt not to have children but decide to adopt children

In kenya, the law requires that no adoption shall commence unless, the child is at six weeks old or less than 18 years.

In addition to that, the adoption applicants must have attained the age of 25 or is at least 21 years older than the child. They also have to prove to the higcourt that they are financially stable to be able to provide for the child.

Others consider to steal or illegaly buy babies which is considered a criminal offense punishable buy the law.

For those considering adoption, it is reasonable to have a clear undestanding on what and how adoption is,how it works in order to have a perfec experience.

How Adoption Process Works

An adoption application is filed in any high court in kenya.

If a child is abandoned, then they must be declared free for adoption by a registred Adoption Society . Kenya Children Home Adoption Society must certify a document to show the child is eligble for adoption.

If a child is 14 years they need to give their consent to be adoplted. A parent/ gurdian must give consent accepting the child to be adopted.

However, the High Court may not give consent for example; if the gurdian is unknown and untraceble , neglected the child, fails to attended the adoption court proceedings.

An Adoption Process may not be issued

if:

  • A sole male applicant is adopting a female
  • A sole female is adopting a male child
  • If the aplicants have attained 65 years of age

Someone of unsound mind, a convict of any sexual offence ,immoral behaviour or unmarried joint applicants are tottally barred from adoption.

Every child needs their support through their life. Supporting a child is more than physical needs , they need both physical and emotional , mental support from the adoptive parents in this lifes up’s and down’s.

As an adaptive parent, you should have a strong commitment from the begining . Accepting the challenges that the child has. You need to be mentally emotionally and financially prepared to accept these challanges as they rise.
