The Officer Commanding Station (OCS) of Lumakanda Police Station in Lugari, Kakamega County, faces charges of defiling a 14-year-old girl. The officer appeared before Senior Resident Magistrate Dorcas Mac’andere on Wednesday, September 30, as the prosecution moved to reject his application for bail and bond.
According to the Office of the Director of Public Prosecutions (ODPP), the accused faces a principal charge of defilement, an alternative charge of committing an indecent act with a child and a separate charge of abusing a position of authority.
“The Director of Public Prosecutions (DPP) has today charged the Officer Commanding Station (OCS) of Lumakanda Police Station with defilement of a 14-year-old girl in Lugari Sub-County, Kakamega County,” ODPP stated.
The accused was ordered to remain in custody until October 1 when the court will consider his application for bail and bond.

The case stems from an investigation by the Independent Policing Oversight Authority (IPOA), which took over the file after it was reported at Lumakanda Police Station on September 27. IPOA stated that its investigators had taken statements, completed site crime scene activities and gathered relevant hospital records. The authority will review available CCTV footage and may conduct an identification parade depending on the results.
IPOA Chairperson Duncan Ojwang’ said they would investigate independently.
“IPOA will conduct a thorough, impartial and evidence-based investigation and will take appropriate action within its statutory mandate based on the findings,” Ojwang’ said.
The allegations against the OCS were initially reported by police and the media, leading to his arrest and presented before the court. Police said their investigation was to determine the truth and collect critical evidence. The accused is yet to be convicted of the alleged crimes and is presumed innocent until proven guilty in a court of law.
