Chebukati risks being jailed for contempt of court

Three High Court judges in Mombasa are today expected to make a decree on whether IEBC Chairman Wafula Chebukati should be put behind bars for contempt.

This comes after The former Nairobi Governor Mike Sonko filled a petition against IEBC chairperson Wafula Chebukati and Mombasa Returning officer Swalhah Yusuf for revoking his clearance certificate to vie for the Mombasa gubernatorial seat.The clearance was revoked after the supreme court decreed that sonko’s impeachment was in accordance to the constitutuon.

However sonko wants action taken against Chebukati and Yusf ,as the court had previously ordered the inclusion of Sonko’s name in the list of candidates vying for Mombasa governor seat.According to Sonko’s petition, the cancellation was done after he had applied for a review of the Supreme Court judgment that proved his impeachment.

Sonko moves to The East African Court of Justice after the supreme court agreed with the decision of his impeachment from office.

“This revocation was done notwithstanding the 1st and 3rd respondents (Ms. Yusuf and IEBC) knowing of the existence of both the review and reference, the same having been served upon them by email, WhatsApp, and letters, .Concerning the above, we, therefore, wish to inform you that your revocation dated 18 July 2022 is illegal and void ab initio without directions of the High Court at Mombasa,”read the petition.
