A 48-year old man is facing life imprisonment after court found him guilty of defiling a 9-yearold girl.
Appearing before Mombasa Magistrate, Martin Rabera, the accused was found guilty, after the court heard the victims testimony.
A statement from the Office of the Director of Public Prosecution on Wednesday said that Magistrate Rabera found the complainant’s testimony to be sufficient enough for conviction.
The defense had applied for a non-custodial sentence, which was strongly opposed by the opposition, they argued that the minor is suffering from trauma and is undergoing counselling.
“The court observed that the accused does not deserve a non-custodial sentence,” wrote ODPP.
“The prosecution, led by PC Barbara Sombo gad opposed the application by the defense for a non-custodial sentence, citing the physical and psychological trauma suffered by the minor.”
They also said that the court found it necessary to impose a severe penalty to tame sexual offenders from committing such crimes in the future.
